The European Commission (EC) and the government of Indonesia joinly fund the Good Governance in the Indonesia Judiciary project. We are contracted by the EC to deliver technical assistant to this project. This is aimed at supporting the implementation of the Mahkamah Agung’s (MA, Supreme Court’s) Blueprint for Reform (2002). The Blueprint is a culmination of reform efforts within the MA and constitutes an integrated reform policy applying to the Indonesian judiciary as a whole. The Blueprint also supports Law No 35/1999 and Law No 4/2004 which mandate that all responsibilities for the judiciary be fully transferred from the Ministry of Justice to the Supreme Court under the “One Roof System”. The European Commission has entrusted us to implement this Technical Assistance effort within the MA and under the guidance of a MA appointed Project Director.
Our objective is to support good governance and democratisation by strengthening the institutional capacity of the judiciary in Indonesia.
- To improve the initial and continuing training of judges and court staff (Component 1)
- To increase the transparency of the courts and accountability of judges (Component 2)
- To increase public awareness of the judicial system and improve public access to justice (Component 3)
Within these components, the following activities are envisaged
Component 1 – Initial and continuing training of judges and court staff
- Improve capacity of Mahkamah Agung Judicial Training Centres to manage training for candidate judges
- Develop practical judicial training programs for candidate judges
- Establish two additional regional training centres for continuing education
- Develop and deliver training programs for continuing education for judges and court staff
Component 2 – Transparency of the court and accountability of judges
- Develop a system for improved case management in six pilot courts (Mahkamah Agung, High Court of Jakarta, District Courts in Padang, Makassar, Mataram and Pontianak)
- Improve electronic access to legal information originating from courts
- Publication of Supreme Court judicial decisions in hard copy
- Develop a new system of judicial evaluation
- Develop judicial conduct guidelines and training for the benefit of the Judicial Commission and the Anti-Corruption Court/Commission
- Train trainers in Office of the Ombudsman on judicial conduct guidelines.
Component 3 – Public awareness of the judicial system and improve access to justice
- Increase public awareness of judicial system and basic civic rights
- Improved access to justice for marginalized groups
- Increase access, availability and use of ADR/mediation techniques.
